WHO IS SHE is a Norwegian brand. All orders within the European Union are fulfilled and dispatched from our EU warehouse located at Bonver Logistics, Gåshaga Brygga 1, 181 66 Lidingö, Sweden. As all EU orders are shipped from within the European Union, no additional customs duties or import charges apply to deliveries within the EU.
SCOPE AND ELIGIBILITY
This website is intended for consumers of legal age in their country of residence. By placing an order, you confirm that you are legally capable of entering into binding agreements. We currently deliver to selected countries within the European Union. We do not ship to Bulgaria, Cyprus, Malta or Poland. We reserve the right to update the list of delivery countries at any time.
CONCLUSION OF AGREEMENT
All products, descriptions and prices displayed on our website constitute an invitation to purchase. When you place an order, you submit a binding offer to purchase the selected products. Once your order has been placed, you will receive an automatic electronic order confirmation and invoice at the email address provided at checkout. It is your responsibility to ensure that the email address entered is correct. The confirmation includes details of your purchase, including product name, price, billing address and delivery address. The order confirmation serves as your receipt and proof of purchase. A binding agreement is concluded only once payment has been successfully processed and you have received a separate shipping confirmation from us. If you do not receive an order confirmation, or if any information appears incorrect, you must contact us without undue delay.
We reserve the right to refuse or cancel orders in cases of pricing errors, technical malfunctions, stock discrepancies, breach of these Terms, or suspected fraudulent activity. In such cases, any payments made will be refunded without undue delay.
PRICES, SHIPPING AND PROMOTIONS
All prices are stated in EUR and include applicable VAT in accordance with EU regulations. The total payable amount, including shipping costs and any applicable fees, will be clearly displayed before you complete your purchase. We offer free standard shipping on orders above 100 EUR. For orders below 100 EUR, a shipping fee of 7.90 EUR will be added at checkout.
DISCOUNTED PRODUCTS
If a product is purchased at a reduced price, including during sales or promotional campaigns, any refund, replacement or compensation will be limited to the amount actually paid for the product. The customer is not entitled to receive a replacement product at its original full price if the product was purchased at a discounted price.
PROMOTIONAL OFFERS INCLUDING FREE PRODUCTS
In campaigns such as "buy X, receive Y free", the free product is considered an integrated part of the overall purchase. If you exercise your right of withdrawal, all items included in the promotion, including any free product, must be returned to receive a full refund. If the free product is not returned, we reserve the right to deduct its value from the refund.
PAYMENT
Payment is processed at the time of purchase via certified third-party payment providers. We accept Visa, MasterCard, American Express and other methods displayed at checkout. We do not store full payment card details.
DELIVERY
Orders are dispatched from our warehouse in Sweden. Estimated delivery time is normally 2–5 business days from the date of dispatch, unless otherwise stated. Delivery times are indicative and not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control, including carrier delays, customs procedures or force majeure events. Risk of loss or damage transfers to you once the goods have been delivered to you or to a third party designated by you.
RIGHT OF WITHDRAWAL
In accordance with EU consumer protection law, you have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period expires 14 days after the day you, or a third party designated by you, acquire physical possession of the goods. To exercise your right of withdrawal, you must notify us through our return system within the 14-day period. You must return the goods without undue delay and no later than 14 days after informing us of your decision to withdraw. Returned items must be unused, in original condition and in original packaging. You are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Customers are responsible for return shipping costs. If you use our provided return label, a return shipping fee of 7 EUR will be deducted from your refund. We will reimburse all payments received from you, including standard delivery costs (excluding any additional costs resulting from your choice of non-standard delivery), within 14 days from the date we are informed of your decision to withdraw. We may withhold reimbursement until we have received the returned goods or proof that they have been returned.
EXCHANGES
We offer free-of-charge exchanges within the 14-day withdrawal period. The exchange must be registered through our return system within this period. Once the returned item has been received and approved, the replacement product will be dispatched automatically at no additional cost. Exchanges are subject to product availability and may only be made for a product of the same value as originally paid. If you wish to receive a product of higher value, you must return the original item and place a new order. This exchange service does not limit your statutory right of withdrawal.
LEGAL GUARANTEE AND DEFECTIVE PRODUCTS
Consumers are entitled to a minimum two-year legal guarantee for lack of conformity in accordance with applicable EU consumer law. If a product is defective, damaged or not as described, you must notify us within a reasonable time after discovering the defect. Where a lack of conformity is established, you are entitled to have the goods brought into conformity by repair or replacement, or, where appropriate, to receive a price reduction or refund. In the case of justified claims, we will cover reasonable return shipping costs. This guarantee does not apply to damage resulting from misuse, improper care, negligence or normal wear and tear.
In addition to your statutory legal rights, pieces from our Waterproof Collection are covered by a lifetime guarantee against color fading. This commercial guarantee applies under normal use and proper care, and does not cover damage caused by misuse, improper care, negligence, accidents or modifications. This lifetime guarantee is provided in addition to, and does not limit, your rights under applicable consumer law.
LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable mandatory law. To the extent permitted by law, we shall not be liable for indirect or consequential losses.
DISPUTE RESOLUTION
If a dispute cannot be resolved directly with us, you may use the EU Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr. Consumers may also contact their national consumer authority.
PERSONAL DATA
We process personal data in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy. Personal data is processed solely for the purpose of fulfilling contractual obligations and providing customer service.
